Please read these Terms of Service carefully before using indexandatlas.com (hereinafter "Site") operated by Index & Atlas, owned and operated by Guy Swenson, Ed.D. (hereinafter "Company"). By accessing or using any content on the Site you agree to be bound by these Terms. If you do not agree with any part of these Terms you may not access the Site.
About Our Services
Index & Atlas provides executive digital presence services for K-12 educational leaders, including leadership profile websites, AI visibility optimization, LinkedIn strategy, and leadership narrative positioning. The information on this Site describes our services and invites interested educational leaders to join our waitlist ahead of our Spring 2027 launch. Nothing on this Site constitutes a binding service agreement. A formal services agreement must be executed and a retainer paid before any services will be provided.
Privacy
Your use of the Site is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy, which governs the Site and describes how we collect and use your information, including information collected through our waitlist form and contact form.
Waitlist and Communications
By joining our waitlist you consent to receive communications from Index & Atlas about our service launch and occasional insights on digital presence for educational leaders. You may unsubscribe at any time using the link provided in any email we send. Joining the waitlist does not create a contractual obligation on the part of either party and does not guarantee availability of services at launch.
Electronic Communications
Visiting the Site, joining our waitlist, or sending emails to Company constitutes electronic communications. You consent to receive electronic communications from Company. You agree that all agreements, notices, and other communications provided to you electronically via email or through the Site satisfy any legal requirement that such communications be in writing.

The Site may contain links to external websites including social media platforms, professional organizations, and educational resources that are not owned or operated by Company. These links are provided as a convenience and do not constitute an endorsement of those sites or their operators. Company is not responsible for the content, privacy practices, or accuracy of any external website. Client Work Product
Leadership Profile content produced by Index & Atlas for Clients is governed by the terms of the individual services agreement between Index & Atlas and each Client. The general methodology, page architecture, design system, color palette system, and content frameworks developed by Index & Atlas remain the intellectual property of Company regardless of their application in individual client projects.
No Guarantee of Results
Index & Atlas makes no representations or warranties regarding specific outcomes from our services, including but not limited to search engine rankings, AI-generated summaries, career outcomes, hiring decisions, or professional opportunities. Our services are designed to optimize the structure and presentation of your professional narrative for digital discovery. The response of search engines, AI systems, and human decision-makers to that content is beyond our control.
Information on this Site about the potential benefits of digital presence optimization reflects our professional experience and opinion. Individual results will vary based on many factors including the subject's existing digital footprint, search engine algorithm changes, and the competitive landscape within their professional field.
No Reputation Management Services
Index & Atlas provides narrative creation and digital presence services only. We do not provide reputation management, search result suppression, content removal, or any services designed to obscure or counteract existing online content. Our services create new, accurate, and intentional content. We do not engage in any practices intended to deceive search engines or AI systems.
User Conduct
You agree to use this Site only for lawful purposes and in a manner that does not infringe upon the rights of others. You agree not to use the Site to transmit any material that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INDEX & ATLAS OR GUY SWENSON, ED.D. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THIS SITE OR THE INFORMATION CONTAINED HEREIN. COMPANY'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THIS SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
This limitation applies regardless of the form of action and even if Company has been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations of liability so some of the above may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless Index & Atlas, Guy Swenson, Ed.D., and their respective agents from and against any claims, losses, costs, and expenses including reasonable attorney's fees arising out of or related to your use of this Site, your violation of these Terms, or your violation of any rights of a third party.
Dispute Resolution
In the event of any dispute arising from or relating to these Terms or your use of this Site, the parties agree to first attempt resolution through good faith negotiation. Should negotiation fail, disputes may be submitted to mediation in Orange County, Florida before initiating formal legal proceedings. Disputes within the jurisdictional limits of small claims court may be submitted to the small claims court of Orange County, Florida.
Governing Law
These Terms are governed by the laws of the State of Florida without regard to its conflict of law provisions, and the applicable laws of the United States of America.
International Users
Index & Atlas is owned and operated in Orlando, Florida, United States. Our services are designed for K-12 educational leaders in the United States. If you access the Site from outside the United States you are responsible for compliance with your local laws.
Access Restriction
Company reserves the right, in its sole discretion, to restrict or terminate your access to the Site at any time and for any reason without notice.
Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be deemed modified to the minimum extent necessary to make it enforceable, and all remaining provisions will continue in full force and effect.
